Following the invalidation of most of the levies that are at the heart of the Republican president’s economic and trade agenda by a lower court, Donald Trump’s administration on Wednesday requested that the US Supreme Court consider a request to maintain his expansive tariffs, which were sought under a 1977 statute intended for emergencies. The Justice Department challenged a federal appeals court’s August 29 decision that the president had overreached himself in using the International Emergency Economic Powers Act, undermining a key Trump aim throughout his second term.<\/p>\n
The tariffs are still in place as of right now since the appeals court postponed its ruling to allow the government to request Supreme Court review. The Justice Department requested a decision from the Supreme Court on whether to consider the case by September 10. Additionally, the Justice Department suggested a quicker timeline for the case’s resolution, with oral arguments scheduled for the first week of November\u2014just one month after the court’s 2025\u20132026 term began.<\/p>\n
Attorneys for small companies contesting the tariffs are not resisting the government’s request for a hearing before the Supreme Court. According to a statement from one of the lawyers, Jeffrey Schwab of Liberty Justice Center, they were sure they would win.
