Jack Smith’s Testimony Regarding Trump Prosecutions is Made Public by Congress

The transcript of former Special Counsel Jack Smith’s testimony, in which he defended his choice to oversee two now-canceled criminal investigations into Donald Trump, has been made public by the US Congress.

The House Judiciary Committee published the 255-page transcript on New Year’s Eve. It includes inquiries from legislators as well as Smith’s forceful defense of the attempts to prosecute Trump for allegedly trying to rig the 2020 election and for unlawfully keeping confidential papers after leaving office. In both cases, Trump entered not guilty pleas, and the prosecutions were dropped upon his reelection.

Video of Smith’s nearly eight-hour deposition testimony, which was conducted behind closed doors earlier this month, is also included in the release. Early in his deposition, Smith tells lawmakers, “I made the decision to bring charges against President Trump, but the basis for those charges rests entirely with President Trump and his actions.”

He claims that under President Joe Biden, his investigation “developed proof beyond a reasonable doubt that President Trump participated in a criminal scheme to overturn the results of the 2020 election and to prevent the lawful transfer of power.
