Jo Malone Filed a Lawsuit for Working with Zara Under Her Own Identity

Estée Lauder Companies is suing British perfumier Jo Malone for using her name in a partnership with high street retailer Zara.In 1999, the US cosmetics giant purchased the rights to Malone’s name as well as her perfume brand, Jo Malone London.

Though the Zara collaboration was with Malone’s new brand Jo Loves, Estée Lauder Companies took issue with the use of Malone’s name on the packaging, which read: “A creation by Jo Malone CBE, founder of Jo Loves.

The company is suing Jo Loves, Jo Malone, and Zara’s UK division for breach of contract and trademark infringement. Jo Malone has been contacted by the BBC for an answer. Zara UK declined to comment. In the past, Malone expressed regret over selling the rights to use her own name for profit.

Under the terms of the 1999 deal, Malone had agreed not to use the “Jo Malone” name for commercial uses, including marketing fragrances. As first reported by the FT, Estée Lauder Companies is also taking legal action regarding passing off, which is when customers are misled into thinking a product is from another company.
