Eminem Has Sued “Swim Shady, An Australian Beach Company

Rapper Eminem of the United States has filed a lawsuit against Swim Shady, an Australian beachwear brand, claiming that the name is too close to his trademarked rap alias Swim Shady.

Eminem, whose real name is Marshall B. Mathers III, petitioned the US Patent and Trademark Office in September to have a trademark issued to the corporation revoked. According to US law, the business must reply to the petition by the next week.

The rapper’s attorneys accused the Sydney company of making a false association with Eminem. With the release of his smash song The Real Swim Shady in 2000, the 53-year-old rapper catapulted to popularity and won a Grammy for best rap solo performance.

Initially operating under the moniker Swim Shade, the Sydney-based company’s name was registered in September 2023, according to Australia’s corporate regulator. The company sells swim bags, portable beach umbrellas, and other beach items.

The company applied for and was granted a trademark in the United States earlier this year. Eminem’s team filed a petition to have the trademark revoked shortly after. According to court records, Eminem trademarked the title “Swim Shady” in 1999, when the album of the same name was released.
