In a unique case involving First Amendment issues, international law, and domestic Brazilian politics, President Donald Trump’s media organisation is suing a justice on the Brazilian Supreme Court.
In the case, Trump Media and Technology Group, the company behind Trump’s favourite social media platform Truth Social, has teamed up with conservative social media firm Rumble to sue Brazilian Supreme Court justice Alexandre de Moraes, who is considering whether to order the arrest of former President Jair Bolsonaro of Brazil for a purported coup.
Moraes ordered the termination or removal of an unnamed right-wing Brazilian commentator and Bolsonaro supporter’s Rumble social media profiles throughout the entire platform in all nations, which Trump Media and Rumble claim violates the US First Amendment.
Trump Media and Rumble want an American judge to rule that Moraes’ instructions are unenforceable in the United States, which is why the action was launched in Florida even though Moraes is neither an American citizen nor headquartered there. The complaint claims that allowing Justice Moraes to silence an outspoken user on an American digital platform would undermine our nation’s fundamental commitment to free and vigorous discourse. “The freedoms guaranteed by the U.S. Constitution and legislation cannot be overridden by extraterritorial orders or foreign court overreach.
