A California drive-through customer was burned when hot tea spilled on his lap, and Starbucks was forced to compensate him $50 million. Michael Garcia’s attorneys claimed that the waitress who brought him three large drinks in February 2020 improperly pushed one of them into the cardboard cupholder.
The drink went over when he picked up the tray, “causing third degree burns to his penis, groin, and inner thighs,” reads a statement from Trial Lawyers for Justice. Michael has been living with the disfigurement, discomfort, dysfunction, and psychological damage brought on by the burns for the past five years following a hospital stay and several skin grafts.
The business, which specializes in no-win-no-fee cases, claimed that Starbucks had offered to pay for $30 million prior to a jury trial, but had rejected responsibility for Garcia’s suffering. Garcia demanded a change in policy and a public apology, but the coffee giant refused, and the issue went to trial.
He was given $50 million by a Los Angeles jury on Friday; according to his lawyers, this amount will ultimately cost Starbucks over $60 million when pre-judgment interest, charges, and legal fees are considered. Starbucks Corporation consistently denied responsibility for five years, all the way up to and through trial, and attempted to escape responsibility,” the statement read.
