Non-Disclosure Agreements That Gagging Employees Should be Prohibited

The government has announced that non-disclosure agreements (NDAs) will no longer be used by employers to silence victims of sexual misconduct or discrimination at work. Any confidentiality agreements that aim to keep employees from discussing claims of harassment or discrimination will be nullified by an amendment to the Employment Rights Bill, which is anticipated to become law later this year.

Angela Rayner, the deputy prime minister, declared that it was “time we stamped this practice out. Since Zelda Perkins, a former assistant to Harvey Weinstein, the Hollywood mogul and now convicted sex offender, violated her agreement to accuse him of abuse, the use of nondisclosure agreements (NDAs) to conceal criminal activity has made headlines.

Recently, it was alleged that Mohamed Al Fayed, the now-deceased owner of Harrods, had used confidentiality provisions to quiet women who accused him of abuse and rape. A legally enforceable agreement that safeguards private information between two parties is called an NDA. Although their applications have expanded over time, they may be used to protect intellectual property or other economically sensitive data. After speaking out against Weinstein more than seven years ago, Ms. Perkins started advocating for a reform in the law.
