Kilmar Abrego Garcia was ordered to be released from ICE detention “immediately” by a federal judge in Maryland, according to a court filing on Thursday. This is a major breakthrough in the case of the El Salvadoran man who was wrongfully deported this year before being brought back to the United States.
Following Abrego Garcia’s erroneous deportation, the Justice Department and the judge have engaged in a heated legal battle. Additionally, it has come to represent the Trump administration’s strong approach to deporting immigrants to distant nations and its immigration enforcement.
District Judge Paula Xinis ruled, “Abrego Garcia has been re-detained, again without lawful authority, since his return from wrongful detention in El Salvador.” Because of this, the Court will grant Abrego Garcia’s request to be released from ICE detention right away.
In recent weeks, the Trump administration has had difficulty locating a nation to deport him to swiftly. If it doesn’t seem likely that detained migrants will be removed from the United States, judges have the authority to order officials to release them.
