In a lawsuit that might decide the future of its extremely profitable App Store, Apple requests that an appeals court halt a recent decision made by a US district judge. In a lawsuit brought by Fortnite developer Epic Games, Judge Yvonne Gonzalez Rogers determined last week that the tech behemoth intentionally disregarded a previous injunction.
The 2021 ruling required Apple to stop engaging in anti-competitive behaviour and pricing and to permit external payment methods in the App Store. She concluded last week that Apple was not meeting that need, a conclusion that Apple has since described as “extraordinary.
Judge Gonzalez Rogers’ two rulings are related to an antitrust action that Epic Games filed. Epic accused the iPhone manufacturer in 2020 of having an unlawful monopoly through the App Store, which took 15% to 30% in fees from in-app sales.
The judge dismissed Epic’s allegations of monopoly, but concluded that Apple was violating California competition laws by preventing developers from providing consumers with other payment choices. She directed Apple to implement modifications that would assist developers in directing consumers to less expensive payment methods outside of the Apple ecosystem.
