After immigration officials acknowledged that they had unintentionally sent a US-based man to an El Salvadorian prison, a US judge delivered a damning ruling against the Trump administration. US District Judge Paula Xinis’s opinion from Sunday reiterates her previous decision to order Kilmar Abrego Garcia’s return to the United States by Monday evening.
According to the judge, Mr. Garcia was detained “without legal basis” and taken “without any lawful authority,” which is a “direct violation” of US law. His predicament “shocks the conscience” and is described as a “grievous error” by her. Trump officials claim they don’t have the power to take him out of El Salvadorian jail, thus they can’t bring him back. The Justice Department has requested that Judge Xinis’ order be overturned by an appellate court. The appeals court is anticipated to make a decision by Sunday night.
Mr. Garcia was one of 23 Salvadorans and 238 Venezuelans who were sent to the Center for the Confinement of Terrorism (Cecot), an infamous mega-prison in El Salvador, by the Trump administration. They might be deported, according to officials, who claimed they were gang members.
Because a US immigration judge in 2019 gave Mr. Garcia legal protection from deportation, it was determined that he had been wrongfully removed. According to his attorney, Mr. Garcia has never been charged with a crime and has denied any gang affiliations.
