For the first time since her murder trial collapsed earlier this month, Lindsay Clancy, the American mother charged with killing her three children, has made an appearance in court. Prosecutors claimed the state had “met its burden” in establishing her guilt, despite her defence team’s Tuesday argument that the judge should dismiss her case.
Although Clancy, 36, does not dispute killing her three children in 2023, her defence team contends that she was experiencing acute postpartum psychosis at the time. The killings, according to the prosecution, were deliberate.
Whether she will be put on trial again is yet unknown. Judge William Sullivan said a hearing on November 2 will address several issues, including the request to dismiss the case.
Kevin Reddington, Clancy’s attorney, filed a motion on Tuesday asking for her to be declared not guilty under Rule 25, a Massachusetts statute that stipulates that a defendant shall be found not guilty if the prosecution fails to provide a strong case. Reddington also presented a fresh defence, claiming there was insufficient proof that Clancy had murdered her kids.
