The security service has admitted that it provided three courts with false material and that senior MI5 officials were dishonest on multiple occasions. This is the first time MI5 has admitted to lying to the courts while defending a violent neo-Nazi spy whose abuse was exposed by the BBC.
The BBC published the lies in February 2025, and the security service vigorously rejected them. Timothy Otty KC, representing MI5, made the announcement during a High Court hearing in London on Friday.
He stated that “MI5 accepts without reservation” the findings of a devastating investigation, which determined that it offered testimony based on “lies” about having followed its key secret principle – known as ‘neither confirm nor deny’ (NCND) – concerning the agent status of the neo-Nazi informant.
The security service claimed to have kept NCND, and as a result, the courts authorised it to keep information from a lady who had been mistreated by him. But what MI5 claimed was false. The security agency had exposed the man’s agent status to me during phone calls in an attempt to encourage me not to probe him in 2020.
