As the Ceuta Situation Persists, Spain Will Update its Asylum Laws to Conform to EU Regulations

As it tries to manage the political consequences from the Ceuta crisis, which saw 80,000 people enter the Spanish city illegally from Morocco in a single day in July, the Spanish government is set to introduce a draft bill to amend immigration and asylum regulations. In response to demands from hardline nations, Madrid stated that the goal is to “bring Spanish legislation into line with the European Pact on Migration and Asylum,” which went into effect this summer and makes it simpler to deny asylum requests and expedite expulsions.

At first, Spain had rejected a significant portion of the legislation, claiming that a more all-encompassing and compassionate approach to migration would be more advantageous. Although Spanish sources maintain that the new system will guaranty fundamental rights, in reality, aligning with the EU will result in tougher penalties. The time coincides with the ongoing Ceuta migrant crisis, which draws attention to Madrid’s management of irregular migration and its efforts to regularize up to 500,000 migrants who are living and working in Spain without proper documentation.

Approximately 5,000 people, including an estimated 2,000 minors, are still in the Spanish enclave, but the great majority of the 80,000 individuals who crossed the border illegally have returned to Morocco. Unaccompanied kids are a particularly delicate issue as Madrid tries to strike a compromise between stringent legal standards and its obligations to Brussels and Ceuta’s regional authorities to deport anyone who entered unlawfully.
